Terms and Conditions 

Acceptance of Terms

By commissioning artwork or purchasing from Jazzio Art (Jazmin Forlin), the Client agrees to be bound by the following Terms and Conditions. It is not necessary for the Client to sign a physical agreement; the act of commissioning or purchasing implies full acceptance of these terms.
 
Please read them carefully before placing any order. By engaging the services or making a purchase, you confirm that you have read, understood, and accepted these Terms and Conditions in full.

Shipping Policy

All artwork is shipped via tracked delivery from Switzerland or can be collected by arrangement. The Client will receive tracking information upon dispatch.
 
International shipping costs will be added to the final invoice. All artworks are securely packaged to ensure safe delivery.

Description of Commissioned Artwork

Commissioned artworks are created on high-quality stretched canvas, with canvas thickness specified before commencement. Each piece is protected with a durable, UV-resistant varnish to prevent damage from dirt, dust, and sunlight.
 
The subject of the artwork will be agreed upon before work begins. This may be based on:

 

  • A client-supplied photograph (e.g., a personal or wedding photo)

  • A design-based portrait

  • A description

The artist will work collaboratively with the Client to select a suitable reference image. However, the artist reserves the right to decline a commission if the provided photo does not meet the quality necessary to produce a professional result.

Reference Photography Rights

If the Client submits a reference photo they do not own, it is their responsibility to obtain written permission from the copyright holder (e.g., the photographer). The artist will not be held liable for any copyright infringements arising from the Client’s failure to do so.

 Returns and Damaged Goods

​Returns are not accepted due to a change of mind.
 
If the artwork arrives damaged, the Client must notify the artist within 48 hours of receipt and provide photographic evidence. The Client is responsible for the return postage of any damaged goods.
 
No refund or exchange will be issued if the damage is reported after this 48-hour window.

Pricing and Payment Terms

Prices are subject to change without notice. However, once a 50% deposit has been paid, the agreed price for that commission is locked and will not increase.

 

A 50% non-refundable deposit is required to secure a commission or reserve original artwork. The remaining 50% is due within 30 calendar days of completion.

Artwork will not be shipped until full payment is received.

If the Client fails to pay the remaining balance within the 30-day period:

 

For original artworks: the piece will be relisted for sale, and the deposit forfeited.

 

For commissioned pieces: the artwork will remain the property of the artist and may be resold (if appropriate for public sale). The Client will not receive the artwork, and no refund will be issued.

If the Client is dissatisfied with the final result and the issue cannot be resolved through minor alterations, they may decline the final payment, in which case the artwork will remain with the artist and may be offered for public sale (excluding clearly personal imagery).

Target Dates and Completion

A completion target date will be agreed upon before work begins. While every effort is made to meet deadlines, these are approximate and may be subject to change due to workload or unforeseen circumstances.
 
The Client will be notified upon dispatch. Once the artwork is handed to the delivery provider, any delays in transit are beyond the artist’s control.

Artwork Progress and Approval

Copyright and Usage Rights

During the creative process, progress photos will be shared with the Client. Minor adjustments may be requested during this stage. Once the artwork is completed and approved, no major changes can be made.

 

Unless stated otherwise (e.g., a surprise gift), the artist reserves the right to share progress shots and final artwork on social media and other platforms.

To fulfill commissions and deliver artworks, the artist may collect personal information including the Client’s name, email address, and delivery address. This information is used solely for:
 

  • Invoicing and communication

  • Fulfilling and tracking the order


Client data will be securely stored during the transaction period and deleted once the artwork has been delivered. Any reference images (printed or digital) will also be deleted or destroyed upon completion.

All artworks remain the intellectual property of the artist, Jazmin Forlin. The artist retains full copyright, including the right to reproduce, publish, or exhibit the work for promotional purposes (e.g., on websites, social media, or portfolios).
 
For privacy, portraits featuring recognizable individuals will only be shared with the Client’s consent.
 
The Client may not reproduce, sell, or distribute the artwork or copies of it (including digital versions) without the artist’s written permission.
